Amendments to Chapter 48 Purchase of Development Rights

On August 18, 2014 the Ann Arbor Charter Township Board of Trustees approved the second reading of an ordinance amendment, Ordinance 1-2014, amending the Code of Ordinances Chapter 48 Purchase of Development Rights, Section 48-25 Eligible Lands and Priority of Acquisition, adding new subsections (f) and (g) in order to create a ranking system to prioritize development rights purchase applications.

Amendment to Zoning Section 74-259 Powers and Duties of the Board of Appeals

The Ann Arbor Charter Township Board of Trustees met on January 19 and approved amendments to the Zoning Ordinance in Chapter 74, Section 74-259 Powers and Duties of the Board of Appeals. The amendments allow the Zoning Board of Appeals to now hear requests from individual property owners within Planned Unit Developments for certain dimensional variances. The amendments, known as Ordinance Number 1-2015 are effective January 29, 2015. Amendments to Sections 74-131, 74-133 and 74-137 Conditional Use Permits General Provisions

The Ann Arbor Charter Township Board of Trustees met on January 19 and approved amendments to the Zoning Ordinance in Chapter 74, Sections 74-131, 74-133 and 74-137 Conditional Use Permits General Provisions, Application and Fee, and Conditions of Approval. The amendments enable and require some Conditional Use Permit applications to be considered in conjunction with a site plan. The amendments, known as Ordinance Number 2-2015 are effective February 3, 2015. Amendments to Chapter 66 - Traffic and Vehicles Ordinance

On August 17, 2015 the Ann Arbor Charter Township Board of Trustees approved the 2nd reading of an ordinance amendment, Ordinance 3-2015, amending Article II of Ordinance Chapter 66 to add  a new division, “Division 3 – Gabriel Richard High School,” Sections 66.59 through 66.61. The ordinance amendment gives the Township and Sheriff‘s Deputies the authority to ticket for vehicles parked in no-parking zones. The amended ordinance is effective August 24, 2015.

Amendments to Section 74-175(a)(1) Requirements for Site Plans

The Ann Arbor Charter Township Board of Trustees met on November 16, 2015 and approved amendments to the Zoning Ordinance in Chapter 74, Section 74-175(a)(1) “Requirements for Preliminary Site Plans – Information Required – Physical Features.” The amendments are an addition for projects located within the Fleming Creek watershed that the Fleming Creek Watershed Council provides a review of watershed impacts and recommendations. The amendments, known as Ordinance Number 4-2015 are effective December 7, 2015.

Rezoning 4283 Ford Road from R-C to R-1

On April 18, 2016 the Ann Arbor Charter Township Board of Trustees approved a zoning ordinance amendment to change the zoning designation of parcel I -09-12-300-016, located at 4283 Ford Road, Ann Arbor, MI and owned by Joan Merritt, consisting of 5.42 acres, from R-C (recreation-conservation) to R-1 (single family rural residential).  The zoning ordinance amendment is consistent with the Township Master Plan and matches the current actual use of the parcel and surrounding parcels.  The Board of Trustees adopted the recommendations of the Planning Commission to rezone after the public hearing held on April 4, 2016.

Medical Marijuana Grow Operations Business License

On October 17, 2016 the Ann Arbor Charter Township Board of Trustees approved the 2nd reading of an ordinance amendment, Ordinance 3-2016, amending Chapter 18 – Businesses to add Chapter III Medical Marijuana Grow Operations. The ordinance amendment creates a licensing process and includes rules and regulations for establishing and operating medical marijuana grow operation. The Township Board approved the ordinance which becomes effective on October 27, 2016.

Medical Marijuana Grow Operation Zoning Amendments

The Ann Arbor Charter Township Board of Trustees met on October 17, 2016 and approved amendments to the Zoning Ordinance in Chapter 74, 74-2, 74-461, 74-462 and 74-465, and Adding Zoning Code Sections 74-613, 74-614, 74-615, And 74-616 “Medical Marijuana Grow Operation.” The amendments, known as Ordinance Number 4-2016 add medical marijuana grow operations definitions and conditional use classifications to the zoning ordinance. The amendments are effective November 3, 2016.

Use of Pavement Sealants

On April 17, 2017 the Ann Arbor Charter Township Board of Trustees approved the 2nd reading of a new ordinance, Ordinance 1-2017, an ordinance to prohibit the use and sale of high-PAH content sealant products, including coal-tar based sealants, within Ann Arbor Township and to require registration of commercial applicators. Educational materials regarding coal-tar sealants, and information regarding alternative asphalt sealants are in the Township newsletter and website. The Township Board approved the ordinance which becomes effective on June 23, 2017.

Amendments to Chapter 70 - Utilities, Water and Sewer Systems

On June 19, 2017 the Ann Arbor Charter Township Board of Trustees approved the 2nd reading of ordinance amendments to Chapter 70 – Utilities, Article II – Water System, Division 2 –Rates, Fees and Charges, Sections 70-71 –Water Rates and 70-72 – Connection Fees, and to add Section 70-81 – Other Fees, and amendments to Article III – Sewer System, Division 2 – Rates, Fees and Charges, Sections 70-242 – Sanitary Sewer Rates, and 70-242 – Connection Fees, and to add Section 70-251 – Other Fees.  The ordinance amendments simplify the current process for determining rates, bring connection fees more in line with other municipalities and allow for long term averaging to smooth out rate fluctuations. The approved ordinance amendments become effective June 26, 2017.

Amendments to Zoning regarding Place of Worship

The Ann Arbor Charter Township Board of Trustees met on June 19, 2017 and approved amendments to the Zoning Ordinance in Chapter 74, Sections 74-2, 74-461, 74-462, 74-463, 74-464, 74-547, 74-761, 74-763, 74-764, and 74-835. The amendments replace the word and definition of “Church” with “Places of Worship.” The amendments, known as Ordinance Number 3-2017 are effective July 3, 2017.

Amendments to Section 74-605 Tree and Woodland Resource

The Ann Arbor Charter Township Board of Trustees met on October 16, 2017 and approved amendments to the Zoning Ordinance in Chapter 74, Zoning Code Sections 74-605(a), (c), (d), (f), (m) and (n)(7), Tree and Woodland Resource Preservation. The amendment clarifies that the Ordinance prohibits the removal of protected trees and woodlands without a permit, if one is required, and that clear cutting pursuant to a woodland stewardship plan is only for long term forest management, and not prior to or in anticipation of development. The amendment adds that a woodland stewardship plan must be (a) approved by the Township Environmental Consultant prior to commencement of forestry management or operations, (b) approved by the State of Michigan Forest Stewardship Program and (c) consistent with generally accepted forestry management practices adopted by the Michigan Department of Natural Resources. The amendment creates an application process including security for installation and survival of mitigation plantings. The amendments, known as Ordinance Number 4-2017, are effective October 30, 2017.
